given here are derived from a number of

different sources.

Questions to the webmaster:

For quite some time I’ve been

bothered by the question of

whether the owner of a homepage

can also be an artificial person

(in this instance a registered

club.) With most clubs only one

individual is registered. How

far do the ownership rights ex-

tend? Can this one person, if he

is no longer a club member, for

example, “freeze” the web page?

Perhaps this subject merits a few

sentences in the Bulletin. I know

that at some clubs they are busy

building their own home pages,

but they don’t have a clue about

these topics . . . .

First of all, an answer to the simple

question: whoever “owns” or “pos-

sesses” a homepage address can obvi-

ously be an artificial person, such as a

corporation or firm. All the addresses

which end with “de” are recorded in the

central register “German Network In-

formation Centre – DENIC”. For other

endings there are similar public lists of

the responsible Registration Organisa-

tion.

The entry for “eaasdc.eu” reads as fol-

lows:

Selbstverständlich kann ich keine Rechts-

auskünfte geben. Die hier wiedergegebe-

nen Ansichten und Fakten stammen aus

allgemein zugänglichen Quellen.

Frage an den Webmaster:

Seit längerer Zeit beschäftigt mich

schon die Frage ob der Inhaber einer

Homepage auch eine juristische Per-

son sein kann (in diesem Fall ein

eingetragener Verein). Bei den meis-

ten Clubs ist eine natürliche Person

eingetragen. Wie weit gehen eigent-

lich dann die Besitz-, Namens- und

Inhaberrechte. Kann diese natürliche

Person, wenn sie nicht mehr Mitglied

z.B. eines Clubs ist, die Page "ein-

frieren"?

Vielleicht ist dieses Thema auch ein

paar Zeilen im Bulletin wert. Von

einigen Clubs weiss ich, dass man

sich dort mit der Erstellung einer

eigenen Homepage befasst, aber von

diesen Sachen keinen blassen Schim-

mer hat. . . .

Zunächst eine Antwort auf die einfache

Frage: der „Inhaber“ oder „Eigentümer“

einer Homepage-Adresse kann selbstver-

ständlich auch eine juristische Person wie

ein e.V. oder eine Firma sein.

Alle auf „.de“ endenden Adressen sind bei

der zentralen Registratur „Deutsches Net-

work Information Center – DENIC“ einge-

tragen. Für andere Endungen gibt es eben-

falls öffentliche Verzeichnisse der zuständi-

gen Registrier-Organisationen.

Der Eintrag für „eaasdc.eu“ lautet dort:

So, “EAASDC e.V.” is registered as the

owner, but you always need a real person

as the contact.

For many the clubs the domain owner

and the contact person are one and the

same. This is often a club member or the

caller, usually the person who was the

first to have Internet access or simply

someone who enjoys the things involved

in building a club homepage. The first

EAASDC homepage was, by the way,

also my private address (very easy to

tell !

).

„EAASDC e.V.“ ist also als Inhaber einge-

tragen, daneben braucht man aber immer

auch eine natürliche Person als Ansprech-

partner.

Bei vielen Clubs sind Domaininhaber und

Ansprechpartner dieselbe natürliche Person.

Das ist oft ein Clubmitglied oder auch der

Caller, meist die Person, die als erste den

Vorteil des Internet erkannt hatte oder ein-

fach aus Spaß an der Sache eine Club-Seite

gebaut hat. Die erste Homepage der

EAASDC hatte übrigens auch meine private

Adresse (sehr leicht zu merken !

).

Back to the subject: another important

point is, who rents and pays for the

server or storage space. Usually it’s the

same person as the one who has the only

password for making changes which ap-

pear under the web address.

It often leads to problems if the owner

of the address and/or the server space

leaves the club under adverse circum-

stances. It goes without saying that the

owner of a trade mark (e.g. Mercedes)

can resist anyone else being allowed to

register a web address like “Mer-

Punkt ist, wer den Server oder den Spei-

cherplatz für die Seiten gemietet hat und

bezahlt. Derjenige hat meist auch als Einzi-

ger das Passwort für die Änderung der In-

halte, die unter der Adresse erscheinen.

Es führt oft zu Problemen, wenn sich der

Eigentümer einer Adresse und/oder des

Serverbereichs in Unfrieden vom Club

trennt. Es ist inzwischen klar, dass sich Be-

sitzer einer Marke (wie z.B. „Mercedes“)

dagegen wehren können, dass irgendjemand

sich eine Web-Adresse wie „mercedes.de“

cedes.de”, and causing a nuisance. In

such an instance the web address belongs

to the owner of the trademark. How this

pertains to club names, I don’t know, but

I suspect that they are not protected. Af-

ter deliberation, courts have usually de-

cided in favour of what the general pub-

lic associates with a name. I’m afraid that

no square dance club name is so well

known that the “General Public” rule

would work.

To be on the safe side, it’s best if the web

address is registered only as the club, and

a club member is registered only as the

contact person and administrator (as with

EAASDC). And then if there is any

trouble, the board will be able to transfer

the web address relatively easily to an-

other server, unless (as with EAASDC)

the server space was also rented from the

club.

My recommendation to clubs who are

having problems because a club member,

who was running a “private” club home-

page, has left:

think of a new address – it’s sufficient

to make a slight midification, e.g. from

“plusdancers.de” to “plus-dancers.de”,

rent a server with this address from

your provider (this requires registration

with DENIC),

take over the data content from the

old server (as long as this doesn’t infringe

upon any copyrights) and

register the new address with Katha-

rina, so that the directory can be up-

dated.

This will avoid any long-term problems,

quickly separates the club from any “ille-

gal” or outdated data, and prevents fur-

ther trouble.

tet. Die Web-Adresse steht in solchen Fäl-

len dem Markeninhaber zu. Wie das mit

Web-Adressen von Vereinsnamen aussieht,

weiß ich nicht, vermute aber, dass sie nicht

geschützt sind. Gerichte haben im Streitfall

meist nach der Vermutung entschieden, was

im Allgemeinen unter einem bestimmten

Namen erwartet wird. Ich fürchte, kein

Name eines Square Dance Vereins ist so in

der Öffentlichkeit bekannt, dass die „All-

gemeinheit“ irgendetwas damit verbindet.

Auf der sicheren Seite ist ein Verein jeden-

falls, wenn die Adresse auf den Verein

selbst eingetragen ist und ein Vereinsmit-

glied nur als Ansprechpartner und Verwal-

ter auftritt (wie bei EAASDC). Im Streitfall

kann dann relativ problemlos vom Vorstand

ein Übertragen der Adresse auf einen ande-

ren Server beantragt werden, sofern nicht

(wie bei EAASDC) der Serverplatz auch

gleich vom Verein angemietet wurde.

Mein Vorschlag an Vereine, die Probleme

mit einem ausgeschiedenen Mitglied und

dessen „privater“ Club-Homepage haben:

eine neue Webadresse ausdenken – es

reicht ja eine kleine Modifikation z.B. von

„plusdancers.de“ in „plus-dancers.de“,

einen Server mit dieser Adresse bei einem

Provider anmieten (der besorgt auch die

DENIC-Anmeldung),

die Inhalte vom alten Server übertragen

(falls nicht darauf Urheberrechte geltend

gemacht werden) und

die neue Adresse an Katharina melden,

damit das EAASDC-Directory geändert

wird.

Dieser Weg vermeidet langwierige Streite-

reien, stellt die aus Sicht des Clubs „illegale“

oder veraltete Seite schnell ins Abseits und

verhindert weiteren Streit.
